1. Introduction
1.1. Thank you for taking the time to check in on something important - your privacy.

1.2. Social Booth Pty Ltd (ABN: 80 675 019 306) (Social Booth, we, us, our) is committed to providing quality photo booth experiences and services to you and our clients. This policy
outlines our ongoing obligations to you in respect of how we manage your Personal Information.

1.3. We take our privacy obligations seriously and are committed to making sure that we handle it with care, transparency, and in accordance with Australian Privacy Principles (APPs) which are contained in the Privacy Act 1988 (Cth) (the Privacy Act).

1.4. By visiting our website, using any of our services (including our photo booths) or otherwise providing us with your Personal Information, you understand and agree that your Personal Information will be handled in accordance with this Privacy Policy.

1.5. We may, from time to time, review and update this Privacy Policy to account for new or amended laws, new technology or changes to our operations and services. All Personal Information that we hold will be governed by our most recent Privacy Policy. We will give you notice about any revisions to our Privacy Policy by updating it on our website at https://www.socialbooth.au
2. What is “Personal Information”
2.1. In this Privacy Policy “Personal Information” has the meaning given to it in section 6 of the Privacy Act (Personal Information). In general terms, Personal Information is any information or combination of information that can be used to personally identify an individual.

2.2. Personal Information may include an individual’s name, age, gender, location, postcode and contact details (including phone numbers and email addresses). It may further include video or audio recordings of your voice or image, financial information, including credit card information and bank details. If the information we collect personally identifies you, or you are reasonably identifiable from it, then it will be considered Personal Information.
3. What is Sensitive Information
3.1. Sensitive Information is a special subset of Personal Information and is defined in the Privacy Act to include information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information (Sensitive Information). 

3.2. Images and photographs captured through our photo booths are Personal Information where an individual is identifiable. In some circumstances, images may also contain Sensitive Information, for example where an individual’s racial or ethnic origin, religious beliefs or health information are apparent from their appearance, clothing, or other visible attributes.

3.3. Due to the nature of our services, we may collect images that incidentally contain Sensitive Information. Where this occurs, we will only collect, use, or disclose that Sensitive Information with your informed and voluntary consent, or where otherwise permitted or required by law.
4. What Personal Information we collect and hold
4.1. We collect Personal Information that is necessary to enable us to deliver our services and as otherwise permitted by law.

4.2. This may include Personal Information such as:
(a) name (first and last);
(b) mailing or street address;
(c) email address;
(d) social media information (where voluntarily provided);
(e) telephone number and other contact details;
(f) payment and transaction details;
(g) time, date and location data associated with a photo booth session;
(h) photographs and images captured during a photo booth session, which may include images of individuals and groups; and
(i) any Personal Information you voluntarily provide when communicating with us or completing forms online or at events.
5. How and why do we collect and use Personal Information
5.1. The primary purpose for collecting your Personal Information is to enable us to perform our business activities and deliver our services to you. We may not be able to provide our
services (in full or in part) if you do not disclose all necessary Personal Information to do so.

5.2. We generally collect Personal Information where you:
(a) engage in our services, including using any of our photo booths;
(b) view or engage with our content, including viewing, accepting, and/or submitting any of our forms;
(c) opt in and agree to have your photographs sent via email;
(d) submit any of our forms, including those required as part of our photo booth experiences;
(e) communicate with us via email, phone, SMS, social applications or otherwise;
(f) interact with our Website, social application services, content, and advertising; and

5.3. We will only collect your Personal Information directly from you unless it is unreasonable or impractical to do so.

5.4. We may collect Personal Information from third parties including third party companies that provide us with your details for business purposes, law enforcement agencies or other
government entities as required by law.

5.5. We may use your Personal Information for the following purposes:
(a) to provide our products and/or services to you;
(b) for record keeping and administrative purposes;
(c) to improve and optimise our service offering and customer experience; and
(d) to comply with our legal obligations,

5.6. As it relates specifically to the use of our photo booths, when you use one of our photo booths your Personal Information is collected for the following purposes:
(a) to capture and deliver your photo booth images to you (for example, by email for digital download, or the physical photos printed and collected by you via the photo booth); and
(b) to disclose your email address to the host venue for the purpose of that venue sending you its own marketing or promotional communications (your consent is asked at the point you enter your email details). Each host venue acts as a separate marketer. The Personal Information we may provide to a host venue is limited to:

- Email Address;
- Name (if provided);
- Date of collection; and
- Mobile number;


You can opt out of receiving marketing from a host venue by using the unsubscribe mechanism in that venue’s messages (if provided) or by contacting the venue directly. You can also contact us at support@socialbooth.au and we will take reasonable steps to assist (for example, by identifying the relevant venue).

We do not share the photos taken from a standard photo booth session with the host venue (unless we are required to do so by law).5.7. You acknowledge that where you use our photo booths during a private booth hire session (for example birthdays, work functions etc.) you understand that the photos taken during the hire period may be requested and provided to the event organiser.

5.8. We may also use your Personal Information for:
(a) secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use;
(b) any other purpose for which we receive consent from you; or
(c) any other purpose which is permitted or required under applicable privacy laws.
6. How do we disclose your Personal Information
6.1. We may disclose your Personal Information to:
(a) our employees, contractors, licensees, or external service providers for the operation of our website or our business, including without limitation IT systems administrators or payment processors;
(b) to the venue hosting the photo booth you have used, after having provided your consent by filling in your email address and/or mobile number;
(c) specific third parties that you authorise to receive your Personal Information;
(d) the police, any relevant authority or enforcement body where we reasonably believe that disclosure is necessary; or
(e) as required or permitted by any law (including the Privacy Act).

6.2. We may provide your Personal Information to external third-party service providers that we engage to perform functions on our behalf. This may include external third party:
(a) database hosts;
(b) data storage and management facilities
(c) IT services;
(d) payment processors; and
(e) any external third party you authorise to receive your Personal Information.

6.3. This Privacy Policy only applies to our services. Your Personal Information will not be shared, sold, rented, or disclosed other than as described in this Privacy Policy.

6.4. We make no representations or warranties about the privacy practices of any external third- party service providers, and we are not responsible for the privacy policies of any external third-party services.
7. Will your Personal Information be shared outside of Australia
7.1. We primarily store your Personal Information in Australia. However, we may use external service providers that receive your Personal Information which may be located or hosted
outside of Australia, this may include cloud storage and other types of networked or electronic data storage.

7.2. We use external third-party service providers that may be located outside of Australia, including:
(a) FotoShare: https://dslrbooth.com/privacy-policy;
(b) Nayax Payment Systems - https://www.nayax.com/legal/nayax-general-privacy-policy/;
(c) WeTransfer - https://wetransfer.com/explore/legal/privacy; and
(d) Gmail - https://policies.google.com/privacy

7.3. The countries in which these service providers may be located (or where their services may be located) may change from time to time.

7.4. We will not transfer your Personal Information to an overseas third-party service provider or a country unless we believe they have reasonable and adequate controls in place including the security of your Personal Information. If you do not consent to your Personal Information being disclosed overseas, you may be unable to use some of our services.
8. Direct Marketing Materials
8.1. We may use your Personal Information to contact you with updates that may be of interest to you, news, or promotional materials. You can opt out of receiving these communications from us at any time by clicking the unsubscribe link in the email.

8.2. These communications may be sent by email in accordance with applicable marketing laws, such as the Spam Act 2004 (Cth).
9. Privacy of Children
9.1. Due to the nature of our services, our photo booths may be used by children at public or mixed‑age venues, and we do not control access to, supervise use of, or verify the age of users. To the extent permitted by law, any use of a photo booth by a child is taken to occur with the consent of a parent or legal guardian (or an event organiser or venue operator acting with appropriate authority), and any Personal Information relating to children is collected only incidentally through normal use of our services. 10. How will we make sure your Personal Information is secure
10.1. We take the security of your Personal Information very seriously. We will take all reasonable steps to protect the Personal Information that we hold from misuse, loss, or unauthorised access. This includes:

(a) local storage deletion: Personal Information stored locally is subject to a regular deletion cycle, generally every thirty (30) days. This includes email addresses and images stored locally.
(b) Temporary cloud storage: Email addresses and associated photographs are temporarily stored on FotoShare’s encrypted servers for a maximum of 135 days, to enable delivery and reporting.
(c) Secure transfer: All data files are shared with clients via encrypted ZIP archives, transmitted through two-factor authentication (2FA) protected transfer links.
(d) Password protection: Passwords for all encrypted ZIP files are securely stored using Dashlane, a password manager with two-factor authentication enabled.
(e) Strict Deletion Policy: We institute a strict deletion policy for all Personal Information we hold and which we no longer require for our purposes.

10.2. If you suspect any misuse or loss of, or unauthorised access to, your Personal Information, please let us know immediately.

10.3. If we suspect any misuse or loss of, or unauthorised access to, your Personal Information we may inform you of that suspicion and take immediate steps to limit any further access to or distribution of it. If we determine that the breach is likely to result in serious harm to you and we are unable to prevent the likely risk of serious harm with remedial action, we will take action in accordance with the Privacy Act.

10.4. If we receive unsolicited Personal Information that we are not permitted to collect under this Privacy Policy, or within the confines of the law, we will destroy or de-identify the unsolicited Personal Information as soon as practicable if it is lawful and reasonable to do so.

10.5. While we take reasonable steps to protect your Personal Information, no method of transmission or storage is completely secure. There remains a residual risk when information is transmitted over the internet.
11. Access & Correction
You may request access to any Personal Information we hold about you and to update and / or correct it, at any time by contacting us at support@socialbooth.au

Where we hold Personal Information that you are entitled to access, we will try to provide you with suitable means of accessing it (for example, by mailing or emailing it to you). We will not charge you for making a request and will not charge you for making any corrections to your Personal Information.

If you make an access or correction request, we will ask you to verify your identity. There may be instances where we cannot grant you access to the Personal Information we hold. For example, we may need to refuse access if granting access would interfere with the privacy of others, or if it would result in a breach of confidentiality. If that happens, we will give you written reasons for any refusal. If you believe that the Personal Information we hold about you is incorrect, incomplete or inaccurate, then you may instruct us to amend appropriately. If we do not agree that there are grounds for amendment, then we will add a note to the Personal Information stating that you disagree with it.

We will destroy or attempt to de-identify your Personal Information if we no longer require it to deliver our services as soon as practicable if it is lawful and reasonable to do so.
12. Complaints
If you believe we have breached your privacy, or you have any questions or concerns about our privacy policy, please contact us using the email support@socialbooth.au and provide sufficient details and supporting evidence of the incident so we can investigate. We will aim to ensure that your complaint is resolved in a timely and appropriate manner.
