2. Agreement
2.1. By accessing or using our Photo Booths you agree to these Terms.
2.2. We may amend these Terms from time to time, by publishing them on our Website or via our Photo Booths. By continuing to use our Photo Booths and Services, you accept any revised terms. Any changes apply prospectively and do not affect completed transactions.

3. Use of our Photo Booths
3.1. You may only use our Photo Booths for lawful purposes and in accordance with these Terms.
3.2. You must not:
(a) misuse, interfere with, damage, disable or disrupt any Photo Booth including any system, software, network, or security feature;
(b) attempt to access any system, data, or content that you are not authorised to access;
(c) use our Photo Booths in a manner that is unlawful, fraudulent, misleading, offensive, or harmful; or
(d) permit any other person to use our Photo Booths in a way that breaches these Terms.
3.3. You agree to use our Photo Booths responsibly and in a manner that does not:
(a) infringe the rights (including intellectual property or privacy rights) of ours or any third party;
(b) involve the upload, capture, display or sharing of unlawful, defamatory, obscene, or inappropriate content; or
(c) cause harm to any person or damage to property.
3.4. You are responsible for loss or damage to our Photo Booths caused by your misuse, negligence, or failure to follow instructions.
3.5. We reserve the right to remove or restrict access to our Photo Booths and any content captured using our Photo Booths where required by law or where reasonably necessary to protect our interests or the interests of others.
3.6. You acknowledge that our Photo Booths are provided at third‑party Venues and involve the use of equipment in public or crowded environments. To the extent permitted by law, you assume all reasonable risks associated with your use of the Photo Booth at a Venue, except to the extent caused by our negligence or breach of these Terms.
3.7. Smoking or vaping is not permitted while using our Photo Booths.
3.2. You must not:

4. Image Storage and Retention
4.1. Images captured using our Photo Booths are stored for a limited period only. We do not guarantee ongoing storage or availability of images once they are made available for download. You are responsible for downloading and saving your images promptly, and we are not liable for any loss or deletion of images after that time, except where required by law.
5. Image Delivery
5.1. We are not responsible for failed, delayed or incomplete delivery of images due to incorrect contact details, device issues, network failures, or user error. Failure to receive images for these reasons does not entitle you to a refund, except where required by law (including the Australian Consumer Law).
6. Use by Children
6.1. Our Photo Booths may be located at licensed premises (bars/pubs/clubs) or age restricted Venues. Use by any person under 18 years old must be in accordance with the Venue’s entry policies and relevant state law or regulations. We are not responsible for Venue entry decisions.
6.2. A legal parent/guardian must supervise children. By allowing a child to use one of our Photo Booths, the parent/guardian consents to the child’s use and the sharing of Personal Information in accordance with our Privacy Policy.

7. Payments & Refunds
7.1. Payment to use our Photo Booths is made using a “tap-to-pay” function. By tapping your credit/debit card or mobile wallet, you authorise a charge to your account for the amount displayed on the Photo Booth interface.
7.2. Thirdparty payment service providers process all payments securely. We do not store full card details, and we are not responsible for any errors, outages or delays caused by third‑party payment systems.
7.3. You are responsible for ensuring that you have sufficient funds and authority to complete the transaction. If a payment is declined, reversed, or charged back, you remain liable for the amount payable.
7.4. Prices displayed at our Photo Booths are inclusive of GST unless stated otherwise.
7.5. All payments made for using our Photo Booths are final and non‑refundable, except where a refund is required under these Terms or the Australian Consumer Law.

8. Photo Booth Hire
8.1. There may be options available to hire our Photo Booths for fixed periods of time. Hire periods are organised via the Venues where the Photo Booth is located (but at all times at our discretion). These Terms will apply to any use of our Photo Booths during any hire period.
9. Indemnity
9.1. You indemnify us against losses (including third-party claims) arising from your breach of these Terms or unlawful use of our Photo Booths and Services, except to the extent prohibited by the Australian Consumer Law.
10. Limitation of liability
10.1. To the maximum extent permitted by law, we are not liable for indirect or consequential loss.
10.2. Our total liability arising out of or in connection with our Photo Booths is limited (at our option) to:
(a) resupplying the Services; or
(b) refunding the amount paid for the Services.
10.3. This clause does not exclude your rights under the Australian Consumer Law.

11. Intellectual Property Rights
11.1. All Intellectual Property Rights regarding our Photo Booths and Services, including equipment, software, systems, branding and content (Social Booth IP) are owned by or
licensed to us.
11.2. Your use of our Photo Booths and Services does not result in any assignment of any Social Booth IP or any other of our rights howsoever.
11.3. You must not copy, modify, distribute or commercially exploit any Social Booth IP without our prior written consent or do anything to infringe the intellectual property rights of any third party.
11.4. Subject to payment of the applicable fee, we grant you a limited, non‑exclusive, non‑transferable license to use images captured using our Photo Booths for personal, non‑commercial purposes only.
11.5. By using our Photo Booths, you grant us a non‑exclusive, royalty‑free license to store and use images captured for operating, maintaining and improving the Services where permitted by law and with your consent.
11.6. You acknowledge that images captured using our Photo Booths may include other individuals. You are responsible for obtaining consent from any person depicted before using or sharing an image. We are not responsible for disputes between users or third parties relating to image use or consent.

13. Statutory Conditions and Warranty
13.1. Consumer Notice: the Services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms purports to modify or exclude the conditions, warranties, guarantees and undertakings, and other legal rights, under the Australian Consumer Law and other laws which cannot be modified or excluded.
13.2. Where any law implies a warranty into these Terms which may not be lawfully excluded then to the extent allowed by law (Warranty), any liability in respect of a breach of Warranty will at our option be limited to:
(a) the resupply of Services, or
(b) the refund of the price paid for the Services.
13.3. We will decide the way that we will discharge any Warranty liability.
13.4. To the extent permitted by law, the following are not covered by Warranty:
(a) failure or defect resulting from your improper care or use;
(b) faulty or incorrect use of our Photo Booths;
(c) unapproved use; and
(d) any maintenance, modification or alteration not conducted by us.
13.2. Where any law implies a warranty into these Terms which may not be lawfully excluded then to the extent allowed by law (Warranty), any liability in respect of a breach of Warranty will at our option be limited to:

14. Suspension and Termination
14.1. We may suspend, disable or terminate access to our Photo Booths and Services immediately if you breach these Terms. Suspension or termination does not affect any rights or liabilities that have already accrued.
15. Governing Law
15.1. These Terms are governed by and interpreted in accordance with the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts in and of Victoria in relation to any dispute under these Terms.
16. Further Terms
16.1. If any provision of these Terms is invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
16.2. We may assign or transfer our rights and obligations under these Terms at any time. You must not assign or transfer your rights or obligations without our prior written consent.
16.3. A failure or delay by us to enforce any right under these Terms does not operate as a waiver of that right.
16.4. Use of our Photo Booths is on an “as available” basis. We do not guarantee uninterrupted, continuous or error‑free operation of these Services, including availability, connectivity or image delivery.
16.5. Nothing in these Terms creates a partnership, agency, joint venture or employment relationship between you and us.
16.6. These Terms constitute the entire agreement between you and us and supersede all prior negotiations, representations, agreements, or understandings, whether oral or written, relating to the subject matter of these Terms.
16.7. We are not responsible for any delay, interruption or failure to provide the Services due to events beyond our reasonable control, including power outages, internet or network failures, Venue closures, equipment damage not caused by us, government directions or emergencies.
16.2. We may assign or transfer our rights and obligations under these Terms at any time. You must not assign or transfer your rights or obligations without our prior written consent.

(a) Australian Consumer Law: means the uniform, national set of rules governing consumer protection and business conduct across all Australian states and territories, formally established in Schedule 2 of the Competition and Consumer Act 2010
(b) Intellectual Property Rights: means all intellectual property rights, including all copyright, patents, trade marks, design rights, trade secrets, domain names, know how and other rights of a similar nature, whether registrable or not and whether registered or not, and any applications for registration or rights to make such application;
(c) Personal Information has the meaning given in the Privacy Act 1988 (Cth).
(d) Photo Booths: means our photo booths, equipment and systems located at Venues.
(e) Social Booth, we, our, us: means Social Booth Pty Ltd (ABN: 80 675 019 306).
(f) Services: means the photo booth services provided by us, including image capture and delivery.
(g) Venue: means any third‑party location where a Photo Booth is installed.
(h) Website: means https://www.socialbooth.au/.
(i) You: refers to any person accessing or using our Photo Booths your has a corresponding meaning.
